
Rubbish Removal Ealing Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Ealing provides waste collection and related services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Service means any rubbish removal, waste collection, bulky item clearance, recycling, loading, transportation, or disposal service provided by us.
1.2 Customer means any individual, business or organisation that requests or receives the Service.
1.3 Waste means any items, materials or rubbish presented by the Customer for removal as part of the Service, excluding items we are not permitted to collect.
1.4 Site means the address or location where the Waste is to be collected.
1.5 Agreement means the contract formed between the Customer and Rubbish Removal Ealing incorporating these Terms and Conditions and any agreed quotation.
2. Booking Process
2.1 Bookings may be made by telephone, email or through any booking facility we make available. The Customer is responsible for providing accurate and complete information when requesting a quotation or booking, including the type and approximate volume of Waste, the access conditions at the Site, and any time constraints.
2.2 Any quotation provided before our arrival is based on the information supplied by the Customer and is an estimate only. The final price may be adjusted on site if the actual volume, weight or nature of the Waste, or the access conditions, differ from the information originally provided.
2.3 A booking is only confirmed when we accept the requested date and time for the Service and provide confirmation verbally or in writing. We reserve the right to refuse or cancel any booking at our discretion, including where we consider the Waste unsuitable or the Site unsafe or inaccessible.
2.4 The Customer must ensure that a person aged 18 or over is present at the Site at the time of collection to grant access, confirm the Waste to be removed and authorise any variations to the quotation. If no authorised person is present, we may treat the booking as a late cancellation and charge a fee, or we may proceed only with prior written consent.
3. Access and Site Conditions
3.1 The Customer must provide safe, reasonable and unobstructed access to the Site and to the Waste at the agreed time. This includes obtaining any necessary parking permissions, access codes, keys or permits in advance.
3.2 Where parking charges apply, these will be added to the final invoice at cost unless otherwise agreed in advance. The Customer is responsible for any penalties incurred due to inaccurate access information provided to us.
3.3 If we are unable to gain access to the Site, or if the Site is unsafe or unsuitable for the Service to be carried out, we may cancel or postpone the Service and charge a call-out or cancellation fee to cover our costs.
4. Description of Services
4.1 Rubbish Removal Ealing provides collection and removal of general household rubbish, commercial waste, garden waste, and certain bulky items, subject to any restrictions specified in these Terms and Conditions or communicated to the Customer.
4.2 Unless specifically agreed in writing, we do not provide specialist removal of hazardous or dangerous materials, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, explosives, gas cylinders, paint cans with liquid content, or any waste classified as hazardous under applicable legislation.
4.3 We reserve the right to refuse to handle any item that we reasonably believe to be hazardous, excessively heavy, contaminated, or likely to cause damage or injury to property, vehicles, personnel or other Waste.
4.4 As part of the Service, we will load the Waste onto our vehicle and arrange for its transportation and disposal at an authorised waste transfer, recycling or disposal facility in accordance with waste regulations.
5. Customer Responsibilities
5.1 The Customer is responsible for ensuring that:
a. All Waste to be collected is clearly identified and accessible.
b. No prohibited or hazardous materials are included with the Waste.
c. Items the Customer wishes to retain are clearly separated from Waste.
5.2 The Customer must not request or require our staff to undertake unsafe practices, including unsafe lifting, working at height without proper equipment, or accessing structurally unsound areas.
5.3 The Customer warrants that they either own the Waste or are duly authorised by the owner to arrange its removal and disposal.
6. Pricing and Quotations
6.1 Our prices are generally based on the volume and nature of the Waste, the weight where relevant, the labour required, and any additional charges such as parking or congestion fees.
6.2 Any quotation provided before the Service is performed is an estimate only and may be revised on site once we have inspected the Waste and Site conditions. If the revised price is higher than the estimate, the Customer has the right to decline the Service before work begins. In such cases, we reserve the right to charge a reasonable call-out fee.
6.3 Where the Customer requests additional items to be removed on the day, or where access is more difficult than described, we may charge extra time or labour fees which will be explained before continuing with the work.
7. Payment Terms
7.1 Payment is due on completion of the Service unless alternative arrangements have been agreed in advance in writing. We accept common UK payment methods such as cash, major debit or credit cards, or bank transfer where agreed.
7.2 For business customers, we may at our discretion offer account or invoice terms. Where we do so, payment shall be due within the period stated on the invoice. If no period is stated, payment shall be due within 14 days of the invoice date.
7.3 We reserve the right to charge interest on overdue invoices at the statutory rate, accruing on a daily basis until payment is received in full. The Customer shall also be liable for any reasonable costs incurred by us in recovering overdue sums, including legal and debt recovery fees.
7.4 We may refuse to perform or complete the Service where payment arrangements have not been agreed, where previous invoices remain unpaid, or where we reasonably suspect fraudulent or unauthorised use of payment details.
8. Cancellations and Amendments
8.1 The Customer may cancel or amend a booking by contacting us directly. We ask for as much notice as possible so that we can reallocate our resources effectively.
8.2 Where a booking is cancelled by the Customer less than 24 hours before the scheduled collection time, we reserve the right to charge a cancellation fee to cover the costs of labour and vehicle allocation.
8.3 If we arrive at the Site and are unable to carry out the Service due to inaccurate information, lack of access, absence of an authorised person, or the presence of prohibited Waste, we may treat the booking as a late cancellation and charge a call-out fee.
8.4 We may need to reschedule or cancel a booking due to unforeseen circumstances such as vehicle breakdowns, severe weather, staff illness or events beyond our reasonable control. In such cases, we will notify the Customer as soon as reasonably practicable and offer a new appointment time. We shall not be liable for any resulting loss of profits, loss of business, or other indirect or consequential loss.
9. Waste Handling and Regulations
9.1 Rubbish Removal Ealing operates in accordance with applicable UK waste management legislation and guidance. We will transport and dispose of Waste at authorised facilities and will take reasonable steps to maximise recycling and recovery where possible.
9.2 The Customer acknowledges that once Waste has been collected and loaded onto our vehicle, ownership of the Waste transfers to us, and we will determine the most appropriate disposal or recycling route in compliance with regulations.
9.3 The Customer must not present for collection any waste classified as hazardous or otherwise restricted by law, including but not limited to asbestos, clinical or medical waste, chemicals, oils, fluorescent tubes, batteries, gas cylinders, pressurised containers, or electrical items requiring specialist treatment unless we have expressly agreed to handle such items in writing.
9.4 Where we agree to collect materials requiring special handling or additional fees, such as fridges, freezers, mattresses or certain electrical goods, this will be clearly identified and priced as part of the quotation.
10. Liability and Limitations
10.1 We will exercise reasonable care and skill in providing the Service. However, we shall not be liable for any loss or damage arising from inaccurate information provided by the Customer or from the inclusion of prohibited or hazardous items within the Waste.
10.2 While our staff will take reasonable precautions to avoid damage when removing items from the Site, the Customer is responsible for protecting floors, walls, fixtures and fittings where necessary. We shall not be liable for normal wear and tear or superficial marks resulting from the reasonable performance of the Service.
10.3 Our total liability to the Customer for any loss or damage arising from the Service, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim, except in cases where liability cannot be excluded or limited by law.
10.4 We shall not be liable for any indirect or consequential loss, including loss of profit, business interruption or loss of opportunity, arising out of or in connection with the Service.
10.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
11. Insurance
11.1 Rubbish Removal Ealing maintains appropriate public liability insurance in relation to the provision of the Service. Details of our insurance cover are available on request.
11.2 The Customer is responsible for ensuring that they have adequate insurance in place for their own property and belongings and for any risks not expressly covered by our insurance.
12. Complaints and Disputes
12.1 If the Customer is dissatisfied with any aspect of the Service, they should contact us as soon as reasonably practicable with details of the issue. We will investigate and seek to resolve complaints promptly and fairly.
12.2 The Customer must allow us a reasonable opportunity to inspect any alleged damage or shortfall in the Service. Failure to notify us of a complaint within a reasonable period may affect our ability to investigate and resolve the matter.
13. Force Majeure
13.1 We shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, fire, flood, strikes, transport disruptions, or government restrictions.
14. Changes to Terms and Conditions
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, services, or legal requirements. The current version will apply to any booking made after the date of publication of that version.
14.2 It is the Customer's responsibility to review these Terms and Conditions before making a new booking. Continued use of our services following any changes constitutes acceptance of the revised terms.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions and any Agreement between the Customer and Rubbish Removal Ealing shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Service, or their subject matter or formation.
By booking or using rubbish removal services from Rubbish Removal Ealing, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
